There might be a break in the case. A monger called County John who is on lots of prostitution boards has come forward with an offer to put up the $9000 dollar bail amount! This is incredible if true, and we are only hours away, from finding out if its true or not? When he made the offer, three or four other mongers also agreed to put up a good chunk of change to lessen the load of $9000, but even then Country John would still in in the hook for about 5K........even I agreed to put up a lot more money if Country John comes forwards with the thousands of dollars to get Sampson out.

Now Country John, wants Sampson to stay and fight the charge, as he doesn't want to be out the money if Sampson jumps bail, but I and others explained to him that Sampson might be better off if he jumps bail, and County John said he is ok with that too., and just wants him out of prison.

Three guys, even maybe one from this site is on the way to Sampson's attorney with the bail money. Lets hope they could pull if off, because I understand Sampson is in really really bad shape right now, as even animals in cages in the US are treated better!

I think Sampson's first bail was set at $20,000, and then it was reduced to $9000, which doesn't sound like a whole lot of money, especially if your stuck in a TJ jail. I understood Sampson was due another hearing which could have reduced the bail even below the $9000 last Monday?

I also understood Sampson to believe that his Mexican attorney might have ripped him off, since he felt he gave his attorney enough money to be able to get bailed out of jail, but it didn't happen. Who knows what happened, because the attorney wanted $8000 to $10,000 dollars to represent Sampson, and at least $3500 dollars to retain his services as a down payment.{ it's very bad news if his attorney ripped Sampson off? If it was me, I'd spend the rest of my life getting even, that's if I got out of the prison.}

The way I heard it the police were arresting one of Sampson's escorts, and Sampson went over to see what was happening, and they got him too. Apparently a payoff was suppose to be made, to who I'm not sure, but the timing was off, and they money blown. It sounds like another double cross, with the arresting cops, taking the bribe money, and still arresting Sampson, or maybe the people in the high power circle in Tijuana wanted Sampson arrested, and the TJ Cops had no choice but to arrest him?

Well I went to court today and not much happened. I get there at 11, and I am told that the 11am appointment will not happen, but the noon will. I didn't know we had two sessions scheduled. At noon a state cop and a municipal cop were there and the had a "face off" with one of their witnesses.

Long story short is their witnesses have all testified that the story did not happen as the police testified. Two other witnesses were suppose to show and one other cop.

I will be getting a new date soon, for another appearance. I am pretty fed up with the whole thing, but not much I can do. I will let everyone know when something happens.

Oh I see my last post was deleted, so I'll post a summary of it.

That's right, Sampson had legal problems before, and really his escort agency, wasn't in business that long. I think he had some success advertising on Craig's list, in San Diego, but soon after that other prostitutes, pimps, or maybe other agencies, starting flagging Sampson's ads, and the staff at CL's deleted all Sampson's ads, without an explanation. As far as I can tell, Sampson only violated the policy or putting his ads in different CL's cities. It's a shame, in this type of business you can't get a business credit line, or even a credit card.

The other thing I said, is Mexican attorneys don't have a very good reputation in Mexico. Burt, says he trusts Samson's attorney, so I'll only talk in general terms, about Mexican attorney's. US attorney are shady, and will rip you off at times, but they'll do it legally, billing you for many hours, costing you a arm and a leg. However, a Mexican attorney, will sometimes flat out steal from you, allowing you to rot in jail, while they run with your money, or lie to you, while really doing nothing at all.

In Sampson's case I believe his attorney has a vested interest in keeping Sampson in prison, because he could earn more money that way. The attorney's fees are about $8000 to $10,000 to represent Sampson's case before the judge, with a $3500 retainer fee. If Sampson makes the bail $9000, he could jump bail, and the attorney will be out thousands of dollars he could have collected trying the case.

Lets hope Sampson's attorney isn't like some of those bad Mexican lawyers?

Is seeing an escort safe, well lets say it's a lot less dangerous that seeing a Craig's list escort or picking up a street Ho in the states. If you pick the right agency, you chances are nil of getting arrested, but I wouldn't say it's exactly without risk. The safest way to pick up a sex provider in Tijuana is go to the zona bar like AB and pick-up a sex worker with a health card, they all should have one, or visit a MP on REVO. It would be best if Sampson answered this and the other quesions on his own. I'll just say that my own experience is things always take longer than attorneys estimate.

What I want to comment on are the laws regarding prostitution. Since I frequently see escorts I wanted to know what they are. First I spoke with Sampson's attorney. Next I spoke with a former Mexican federal prosecutor who is now an attorney in private practice. They both told me the same thing, one even gave me the civil code and let me read the law for myself.

A lot of guys seem to have problems understanding Mexican law. Probably because they're expecting a simple it's legal/illegal type of answer. The first thing to understand is the laws in Mexico regarding prostitution are different (and more complex) than those in the U.S. The second is that Mexico is still a “man's country” and the laws are written to protect/benefit men who visit prostitutes.

Prostitution in Mexico is governed by state and municipal law, not national law. What follows applies to Tijuana, but not necessarily to other parts of Mexico. Below are answeres to some of the questions I asked the attorneys.

Is prostitution legal in Tijuana?
Yes. As long as both parties can give lawful consent. (Lawful consent means they are at least age 18, mentally competent, not legally intoxicated, etc.)

Isn't prostitution in Tijuana illegal outside the Zone of Tolerance (ZN)?
No. Prostitution is legal everywhere in TJ. What is illegal outside the Zone of Tolerance is solicitation; what in Mexico is termed “public manifestation of prostitution.” Prostitutes can only solicite customers from the sidewalk within the Zone of Tolerance. (Note: e-mail, telephones, etc. are private—not public—forms of communication.) If prostitution were illegal outside the Zone of Tolerance then the La Mesa bars--Titanic, Siete de Copas, Hairy Cave, etc.--couldn't operate. You only see SGs in the ZN because that's the only place public solicitation is allowed.

Does a prostitute need a health card?
Yes. She can be fined for not having a health card. (But it’s a violation of the health and safety code, not the criminal code.)

Can I be arrested if a prostitute doesn’t have a health card?
No. (Remember what I said about Mexico being a “man’s country.”) You’re not legally responsible for the actions of others. It’s sort of like eating at a restaurant that doesn’t have a business license. You’re not legally obligated to inspect the permits before doing business with either a restaurant or a prostitute.

Can an escort agency get a license?
No. Pimping and pandering is illegal in Tijuana; so is running a brothel. An agency owner can legally operate a dating service. He can legally operate a hotel where prostitutes see clients. Etc. Etc. But in Tijuana nobody can legally operate an escort agency or brothel. (That’s why you pickup a chica in a bar and go to a hotel next door. BTW, the reason bars have curtains covering their doors is the curtains makes what transpires within a private—not public—activity.)

Can I be arrested for seeing an escort?
No. Neither can you be arrested for seeing a SG who has a padrote. (Remember what I said about Mexico being a “man’s country.”) You’re only responsible for your own actions. You can’t be arrested because somebody else—a padorte—is breaking the law.

Note: An area I didn’t cover when speaking with the attorneys is transvestite prostitution. That probably is seen as a homosexual activity and may still be illegal in Tijuana. Even if it is legal it is not accepted. If you see "ChicoChicas" expect problems if the cops catch you. (IMHO breaking a country’s social mores will cause you more problems than breaking its laws.)

I spent yesterday in TJ and took Carolina to see Sampson's attorney. I don't expect another bail reduction--but do hope I'm wrong.

The next major court date will be May 18th. It is something like a preliminary hearing. While it is possible the case will be dismissed I doubt that will happen.

We again found the clothes and gave them to the attorney. Hopefully he received them today. (But maybe not. For all I know the guards are still "playing games.")

I think Theresa has recieve more donations since the figures above were accumulated. But there is still a long ways to go.
