Alleged incident happened at Har Mar massage parlor
A Roseville man who worked at a Har Mar Mall massage parlor has been charged with criminal sexual conduct for a November 2016 incident that reportedly took place at the business.
Marion Guy Anderson, 37, was charged Jan. 6 with one count of fourth-degree criminal sexual conduct, a felony, for allegedly having nonconsensual sexual contact with a 26-year-old St. Paul woman to whom he was giving a massage.
According to the criminal complaint, the incident happened the evening of Nov. 26 at the Har Mar location of Massage Elements, 2100 Snelling Ave. Court documents indicate Anderson was fired by the business.
Last year, Anderson was issued a massage license by Roseville, which was approved by the city council. However, during a background check, according to court documents, Roseville learned Anderson had been denied a Plymouth massage license by that city’s council in 2013.
Anderson was investigated by Plymouth police for alleged inappropriate sexual contact with a female client that same year, court documents say. Though the woman declined to press charges against him, investigators did find that Anderson’s Plymouth massage license had expired in 2012, and since he continued to give massages, in violation of city code, Plymouth denied his application for a renewal on May 14, 2013.
Since Anderson was never convicted of anything related to the 2013 investigation, court documents said Roseville city officials did not have cause to deny his license application. His Roseville massage therapist license was one of 65 approved June 13, 2016, as a part of the Roseville council’s consent agenda.
The maximum sentence for fourth-degree criminal sexual conduct is 10 years, a $20,000 fine, or both. Anderson posted $40,000 bail Jan. 7 and his next court appearance is Jan. 30.
Massage starts with a hug
According to the criminal complaint against Anderson, he allegedly greeted the woman at the massage parlor and said, “I’m not supposed to do this but I’m going to give you a hug.”
The woman told police she thought it was strange but brushed it off. Court documents say she went into a massage room and undressed while Anderson was outside, leaving her bra and underwear on.
When Anderson returned, the complaint says he began giving the alleged victim a massage before telling her to remove her bra because it was getting in the way; she did so. Anderson allegedly massaged the inside of her thighs, close to her vagina, while continuing to make conversation. The woman told police she was uncomfortable and thought he’d been flirting with her, but she didn’t know what to do.
Anderson allegedly told the woman, who is Asian-American, that he likes “her people,” and he asked about her “status,” court documents say. The woman said she had a boyfriend.
The massage continued for 10 or 15 minutes before Anderson allegedly told the woman he didn’t care if she had a a boyfriend. He told her to remove her underwear because it too would get in the way, and her body was covered only by a sheet.
Anderson allegedly climbed onto the table and massaged the woman’s back, then began rubbing her stomach as well, with his entire whole body pressed against her back. Anderson allegedly removed the sheet and began spreading her legs apart, while continuing to rub her, and the woman felt Anderson’s genitals and testicles on her back near her buttocks.
The woman told police that at that point she said, “I’m good now,” and told Anderson she felt uncomfortable. He put the sheet back on her and the woman said she heard him zip up his pants.
Anderson allegedly apologized and asked the woman to “pinky promise.” The woman told police she challenged him, asking him, “Pinky promise for what?” though he did not respond. Anderson allegedly stayed close to the woman as she left; she told police it seemed like he was worried she would say something to his supervisor.
The woman left the business, though on second thought, she returned, and told the manager what had happened, court documents state. The manager reportedly apologized, and after the woman talked it over with her boyfriend, they decided to report the incident to Roseville police.
She talked to investigators on Nov. 27; Anderson was arrested at his residence in Roseville on Jan. 5.
Roseville police are asking anyone who might have been victimized by the suspect to call Detective Jamie Baker at 651-792-7250.
